VA TDIU Evidence Guide: Forms 21-8940 & 21-4192, Earnings, and Vocational Reports

Schedular and extraschedular TDIU eligibility criteria

Under 38 CFR 4.16(a), schedular TDIU requires either a single service-connected condition rated at 60% or higher, or a combined rating of 70% with at least one condition rated at 40% or higher. If a veteran does not meet these percentages but is nonetheless unemployable due to service-connected disabilities, the claim is referred under 38 CFR 4.16(b) to the Director of Compensation Service for extraschedular consideration.

Completing VA Form 21-8940 with precision

VA Form 21-8940 (Veteran's Application for Increased Compensation Based on Unemployability) is the mandatory formal application for TDIU. You must list all service-connected disabilities that prevent work, your complete five-year employment history, the date you became unable to work, and any annual earned income. Detailed descriptions of physical and psychiatric limitations are vital.

The employer certification on VA Form 21-4192

The VA sends VA Form 21-4192 to your past employers from the last 12 months of employment. This form gathers objective evidence: why your employment terminated, how many sick days or personal leave days you used, whether special accommodations were provided, and whether productivity was substandard. If a former employer fails to respond, submit a statement explaining why.

Substantially gainful employment versus marginal employment

Under 38 CFR 4.16, earning marginal employment income does not disqualify a veteran from TDIU. Employment is considered marginal if annual earned income does not exceed the federal poverty threshold for a single person, or if the veteran works in a protected environment (such as a family-owned business or sheltered workshop where accommodations shield the veteran from normal labor market expectations).

Because VA C&P examiners are medical clinicians rather than vocational specialists, submitting a private Vocational Assessment provides compelling evidence. A certified vocational expert analyzes your specific functional restrictions (lifting limits, panic attacks, off-task time, absenteeism) against the Department of Labor's Dictionary of Occupational Titles to establish total unemployability.
