Statutory Defense Guide: Proposal to Reduce

If the VA sends you a letter proposing to reduce your rating, do not panic. You have strict legal rights under 38 CFR § 3.103.

Right to Pre-Determination Hearing

You have a 60-day window to respond to a proposal to reduce. If you request a hearing within 30 days, the VA cannot reduce your rating until the hearing takes place and a final decision is made.

Sustained Improvement Requirement

For ratings held 5+ years, VA must prove your condition has materially improved under the ordinary conditions of life and work, not just on a single exam on a single day.
